Rental Home Automator controls physical devices in your property, including but not limited to locks, thermostats, water systems, sensors, switches, and other connected devices.
Automations may fail, be delayed, or not execute as expected.
You are solely responsible for verifying device behavior and maintaining safe property conditions.
The Services are not a security system and must not be relied upon for safety or emergency access.
1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “User”) and Rental Home Automator, LLC (“Company,” “we,” “us,” or “our”), a Florida limited liability company.
By accessing or using our software, applications, or services (collectively, the “Services”), you agree to be bound by these Terms.
If you do not agree, you must not use the Services.
2. Description of Services
Rental Home Automator provides software that enables users to monitor and automate smart home devices, including but not limited to:
- Smart locks and access codes
- Thermostats and environmental controls
- Water valves and leak protection devices
- Lights, switches, and sensors
- Calendar-based automation triggers
The Services rely on third-party platforms, devices, and integrations.
3. No Guarantee of Automation or Execution
You acknowledge and agree that:
- Automations may fail, be delayed, or not execute at all
- Commands may be queued, retried, delayed, or dropped
- Device state may not reflect expected outcomes
- Internet connectivity, device availability, and third-party services may impact performance
We do not guarantee that any automation, command, or device action will occur successfully or on time.
4. User Responsibility
You are solely responsible for:
- Verifying that devices operate correctly
- Confirming guest and authorized user access to the property
- Ensuring safe temperature levels and environmental conditions
- Monitoring property conditions at all times
- Maintaining backup access methods (e.g., physical keys)
- Maintaining working devices, connectivity, and power
You must not rely solely on the Services for critical property operations.
5. Not a Security or Emergency System
The Services:
- Are not a security system
- Are not a life-safety system
- Are not an emergency response system
They must not be relied upon to:
- Prevent unauthorized access
- Protect against theft or intrusion
- Ensure guest safety
- Provide emergency access to property
6. Device and Property Risk Disclaimer
You acknowledge that the Services interact with physical devices and property systems.
To the fullest extent permitted by law, Rental Home Automator is not responsible for any damage, loss, or injury resulting from the use of the Services, including but not limited to:
- Lock malfunctions or access failures
- Failure of guests, owners, or authorized users to access the property
- Guest lockouts or denied entry
- Water damage, flooding, or valve failures
- HVAC issues, freezing pipes, overheating, or temperature-related damage
- Device malfunctions, offline devices, or connectivity issues
- Automation failures, delays, missed triggers, or incorrect execution
- Failures caused by third-party platforms, devices, or integrations
Use of the Services is at your own risk.
7. Third-Party Services and Dependencies
The Services depend on third-party platforms and providers, including but not limited to:
- Smart home platforms (e.g., SmartThings)
- Device manufacturers
- Calendar providers (e.g., Airbnb, iCal feeds)
We do not control and are not responsible for:
- Outages, failures, or changes in third-party services
- Device compatibility, reliability, or behavior
- Data accuracy from third-party integrations
If a third-party service fails or changes, the Services may not function properly.
8. User Responsibilities for Devices and Integrations
You agree to:
- Maintain devices in proper working condition
- Ensure devices remain connected, authorized, and accessible
- Replace batteries and maintain hardware
- Maintain reliable internet and network connectivity
- Maintain valid integrations with third-party services
Failure to do so may result in automation failure or incorrect behavior.
9. Subscriptions and Billing
9.1 Billing
Subscriptions are billed on a recurring basis per unit or location.
9.2 Non-Payment
If payment fails or is not received:
- Your subscription may be immediately suspended or canceled
- Automations may be disabled without notice
9.3 Cancellation
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- All purchases are non-refundable
10. Effect of Cancellation or Disablement
When automations are disabled or a subscription ends:
- All automations will stop
- The system will attempt to delete all codes created through the Services
- Device control and integrations may be removed
Deletion of codes is not guaranteed if:
- Devices are offline or unreachable
- Access permissions are revoked
- Third-party integrations are disconnected or unavailable
11. Data and Access
You grant us permission to:
- Store and process device data, automation logs, webhook history, and calendar data
- Access third-party systems using authorized tokens
- Perform actions necessary to deliver the Services
We do not store:
- Payment card information (handled by third parties such as Stripe)
- Third-party account credentials (only access tokens)
12. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
We disclaim all warranties, express or implied, including:
- Reliability or availability of the Services
- Accuracy of automation outcomes
- Fitness for a particular purpose
13. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, consequential, or special damages
- Our total liability is limited to the amount paid by you in the six (6) months prior to the claim or $500, whichever is less
14. Indemnification
You agree to defend, indemnify, and hold harmless Rental Home Automator from any claims, damages, or expenses arising from:
- Your use of the Services
- Device behavior or automation outcomes
- Property damage or guest-related issues
- Your violation of these Terms
15. Termination
We may suspend or terminate your account at any time.
Upon termination:
- Access to the Services may be revoked
- Automations may stop
- Data may be retained as required by law
16. Governing Law
These Terms are governed by the laws of the State of Florida.
17. Changes to These Terms
We may update these Terms at any time.
Continued use of the Services after changes constitutes acceptance of the updated Terms.
